Legislative rules aimed at protecting personal data (PD) are found in the Constitution of the Republic of Belarus and other regulatory acts, but the main one is the law of the Republic of Belarus 99-Z "On the protection of personal data", noted Nikita Volodin, senior consultant on the protection of PD at the company "B-152", at the webinar "Comparison of legislation on personal data in Russia, Belarus and Kazakhstan".
The authorized and supervisory body for the protection of PD in Belarus is the National Center for Personal Data Protection. "Despite the fact that the Center appeared relatively recently, it carries out content writing service active educational activities among operators, provides explanations on working with PD, develops the main forms of documents (policies, consent to the processing of personal information) and conducts inspections," explained Nikita Volodin.
Seda Antonyan, a personal data protection consultant at B-152, said at the webinar that Kazakhstan also has a separate regulation on personal data – Law 90-V “On personal data and its protection”. “In addition, the republic has a large number of by-laws that regulate the processing of personal data and which the operator will always need to remember when working in this jurisdiction,” she emphasized.
The authorized body for the protection of personal data subjects in Kazakhstan is the Ministry of Digital Development, Innovation and Aerospace Industry of the country. Also, the country's law on personal data states that the prosecutor's office is the highest supervisory body for compliance with the protection of the rights of personal data subjects, Seda Antonyan said.
